Congratulations to our Garden City Office Partner, Gerald Murphy, for obtaining summary judgment on a complex high exposure medical malpractice case involving a 10-month-old infant plaintiff. In this case, the parents of the infant commenced a lawsuit against multiple defendants, which included various metropolitan hospitals, as well as over a dozen physicians with varying medical specialties. Summarily, it was alleged that the defendants failed to timely diagnose, treat and remove a foreign object lodged in infant plaintiff’s larynx resulting in a life-threatening situation, severe edema, stenosis, scarring and the need for a tracheostomy. With respect to our clients, it was alleged that the defendants failed to properly manage the infant plaintiff’s care resulting in an improper delay of treatment and the need for a tracheostomy. Notably, our client, a pediatric ENT was the physician who eventually discovered an impacted plastic foreign object that had become embedded in the interarytenoid/post cricoid space during an exploratory surgical procedure, which resulted in a tracheostomy due to severe edema of the larynx and pharynx. Notably, the Court denied the dispositive motions made by various other co-defendants, however, the case against our clients has been dismissed and their names will be deleted from the caption of the lawsuit.
