Jonathan M. Waldauer

TRIAL AND APPELLATE PARTNER

Jonathan concentrates his practice on New York State medical malpractice and Public Health Law litigation and has extensive experience in all stages of litigation, including discovery, trials, post-trial motion practice, and appeals. He has successfully obtained numerous contested summary judgments, defense verdicts, and reduced damage awards. He has particular expertise in case valuations, litigation strategies, and damage mitigation techniques.

Jonathan received a Bachelor of Arts degree in English Literature from the University of Rochester. He is a graduate of Rutgers University School of Law – Newark where he was a student attorney with the Child Advocacy Clinic for his 2L and 3L years, studying under Professor Randi Mandelbaum. He served as a confidential law clerk for the Honorable Frederic S. Kessler, J.S.C., Superior Court of New Jersey, Union Vicinage for one year after law school, before representing children with the Children’s Law Center in Brooklyn in custody, visitation, and abuse and neglect hearings. In 2011, he began working representing doctors, medical providers, hospitals, nursing homes, and medical facilities. He has worked in-house at NYC Health + Hospitals as well as several defense firms over the past 15 years. He was named a Partner at Rubin Paterniti in March 2023.

Jonathan is an amateur baseball and basketball coach who has been coaching his two son’s teams for the past 10 years which the firm has been kind enough to sponsor for the past two. He is still looking for his first championship as a player or coach.
