We are pleased to report a significant summary judgment victory on behalf of our municipal client in a roadway design defect case.
The Supreme Court, Suffolk County granted our motion for summary judgment and dismissed the action against our client, finding that the municipality demonstrated its entitlement to qualified governmental immunity for its roadway planning and design decisions. The Court recognized evidence that roadway and traffic conditions had been studied over time and that various traffic-calming measures had been considered and implemented.
The Court further found that plaintiffs’ expert submissions failed to raise a triable issue sufficient to defeat summary judgment, resulting in a complete dismissal of the claims against our municipal client.
