On February 6, 2026, RPGRK Partners Steven Rubin and Juliann O’Meara secured a defense verdict from a Kings County jury on behalf of our client radiologist and radiology practice. The case involved allegations that the radiologist negligently failed to appreciate a mass and other abnormalities on a chest x-ray of the then 37-year-old female plaintiff. The patient was diagnosed 13 months later with an Il cm malignant thymoma in the upper chest.

The thymic malignancy unfortunately metastasized to the liver in 2024, and plaintiff’s expert claimed that the alleged delay in diagnosis would significantly increase the chances for further recurrences and reduce the plaintiffs life expectancy.

Despite the sympathetic nature of the case and plaintiffs attorney’s request for a $I2 million award, the jurors awarded a defense verdict finding that the radiologist did not depart from good practice in his interpretation of the chest study.
