Associate, Bryanna Corbett, successfully obtained summary judgment on behalf of our client hospital. The then 17-year-old plaintiff suffered from a congenital vaginal defect and underwent prior unsuccessful reconstruction surgery in Santo Domingo, resulting in ongoing heavy bleeding and pain. The plaintiff was then evaluated in New York by co-defendant private OBGYN and underwent a total abdominal hysterectomy at our hospital in 2016, resulting in a ureteral laceration.

Plaintiff also alleged a delay in diagnosis of the ureteral laceration, urosepsis, pelvic inflammatory disease and multiple additional surgical complications. Specific to the hospital were claims that the issued Medical Ethics Consultation Report deviated from accepted standards of care.

The defense submitted expert affirmations in the fields of urology, pediatric gynecology, and bioethics to establish our prima facie showing. Plaintiff’s counsel was unable to oppose the motion and summary judgment was granted on behalf of our client only.
