Unanimous Defense Verdict for Nursing Home Operator

Partner Steve Rubin and Associate Jill Greenfield successfully represented a nursing home operator, culminating in a unanimous defense verdict on claims pursuant to Public Health Law § 2801. Plaintiff alleged that defendant’s violation of the Public Health Law resulted in the development of multiple Stage 4 decubitus ulcers throughout the sacrum and lower extremities, including the heels and feet, some continuing to the present. Plaintiff’s counsel alleged numerous Public Health Law violations and in summation requested from the jury $3,000,000 in compensatory and punitive damages. The jury, however, returned a unanimous verdict for our client, finding that no violations were committed.
