Associate, Joseph Ognibene, obtained summary judgment dismissing all claims against our client, a large utility company, in an action brought by a double-decker tour bus guide who allegedly sustained significant orthopedic injuries when the bus struck a roadway defect, causing the bus to suddenly drop. As a result, plaintiff –– who was walking to the back of the bus at the time –– was thrown backwards, striking a pole and allegedly sustaining serious personal injuries. Joe presented detailed papers, along with deposition testimony and supplemental witness affirmations establishing that our client neither caused nor created any roadway defect, that no adjacent street hardware owned by the client, or other nearby street work by the client, was involved in the incident. Despite multiple requests to adjourn the motion, no party formally opposed Joe’s formidable papers, a resounding victory for the client.
