On May 28, 2025, Senior Trial Attorney, John Paterniti, obtained a directed verdict in Supreme Court, Suffolk County. The plaintiff alleged that that our client hospital was negligent in failing to properly monitor and implement appropriate fall precautions, causing the then 73-year-old patient to fall and sustain a hip fracture, resulting in death. After the close of evidence presented by the plaintiff, we moved to dismiss this action in its entirety based on the lack of expert testimony as to departures and proximate cause. We argued there was no testimony or evidence to support a claim that more stringent fall precautions should have been in place. Due to a diligent work-up of this case, and John’s exceptional skills at trial, we were able to obtain a defense verdict in our favor. John was assisted by Associate, Angela Criscuolo, who handled daily management of the file through trial.
