RPGRK Partners Steven I. Rubin and Jonathan M. Waldauer, with the assistance of Associate Josephine Accetturi Secure Defense Verdict in Queens County Bilateral Amputation Case

On December 4, 2025, in Queens County Supreme Court, RPGRK partners Steven Rubin and Jonathan Waldauer, with the support of Associate Josephine Accetturi and Senior Paralegal Samantha Mooney, secured a defense verdict on behalf of our client interventional radiologist and his practice.

Plaintiff alleged our client negligently performed an angiography procedure and that he improperly performed it in the outpatient setting. The female plaintiff developed internal bleeding and lower leg clots resulting in a below-the-knee amputation on the right, a forefoot amputation on the left, hemorrhagic shock, kidney failure, months of inpatient rehabilitation and future pain and suffering.

With the assistance of a top national vascular surgery expert, we argued the interventions were appropriately performed and that the complications sustained by plaintiff were known and accepted risks of the intervention. After a 3-week trial, plaintiff counsel requested a $12 million award for his client. The jury deliberated for less than 3 hours before returning a verdict in favor of the defense.
