On April 3, 2025, Senior Trial Attorney, John Paterniti, obtained a unanimous defense verdict before the Honorable Andrew Cohen in the Bronx County Supreme Court.

The plaintiff alleged that our client was negligent in the performance of a surgery to address a complex mid-shaft fracture of the tibia and fibula by improperly inserting orthopedic hardware, resulting in multiple additional fractures and destruction of the meniscus and cartilage in the knee joint. Plaintiff claimed that as a result, she was required to undergo two additional surgeries and was left with permanent disability, persistent pain and inability to bend her knee. Through the testimony of our experts in Orthopedic Surgery and Radiology, and with extensive use of x-rays, MRIs as well as illustrations that were created to specifically show plaintiff’s anatomy with the hardware in place, John was able to establish that the surgery was properly performed. Moreover, he demonstrated that the surgical complications encountered were known risks of the procedure. After extensive deliberations, the jury returned a verdict in favor of the defendant on all three liability questions presented.
